Key Aspects to Register your Tequila Brand

The art of registering a tequila trademark goes beyond a flashy label. Discover the crucial aspects that shape your brand's legal identity and protect it in the competitive world of spirits.

  • Availability Search: The Crucial First Step
  • Correct Classification: Niza Class (32)
  • International Protection: Think Global
  • Ongoing Maintenance: Legacy Watch

Tequila is experiencing a global boom, and major alcoholic beverage companies are seeking to include brands of this iconic Mexican beverage in their portfolio. Despite the demand, the Tequila Regulatory Council (CRT) stresses the importance of following legal procedures, as the registration process can take from months to years.

According to Ramón González, general director of the CRT, the speed of registration depends on complying adequately with the legal requirements and filing the application accurately. The work of the Mexican Institute of Industrial Property (IMPI) is essential, as it filters the applications to avoid phonetic similarities and to ensure that there are no previously registered trademarks.

The CRT has a register of 1,761 trademarks, with a notable increase in the last 25 years. The collaboration between the CRT and IMPI has contributed to this exponential growth by applying rigorous criteria for the registration of trademarks.

The process is complicated when the applications are poorly presented, and the advice of lawyers specialized in intellectual property is essential to speed up the process. Although registration is now done electronically, the possibility of opening an IMPI module at CRT's facilities is being considered to further facilitate the process and promote exports.

The cost to register a trademark is $2,457.79 MXN pesos plus TAXES. However, the factor that can slow down the process is the choice of name, since inappropriate names, as in the case of "Cabrón", are rejected for not complying with ethical standards. The CRT and IMPI seek to ensure that the names do not denigrate the category of tequila and contribute to highlighting its culture. In its 25 years of existence, the CRT seeks for the appellation of origin to compete globally while maintaining the dignity of the national beverage.

Search Availability

In the complex process of registering tequila trademarks, one of the first and fundamental steps is the search for name availability through the Mexican Institute of Industrial Property (IMPI). This critical step seeks to ensure that the proposed trademark is unique, avoiding phonetic similarities with existing trademarks and guaranteeing the originality of the name. Below, we explore the importance of this step and how it influences the success of the registration.

  • Avoid Phonetic Similarities
  • That names do not denigrate the category
  • Guarantee Originality
  • Legal Conflict Prevention

Since the IMPI search involves a thorough review and specific legal criteria, the advice of experienced intellectual property attorneys is essential. These professionals help interpret the search results and provide guidance on the viability and originality of the proposed name.

A well-executed availability search speeds up the registration process by avoiding subsequent rejections. The results of the search guide the applicant on the viability of their choice of name, contributing to a more efficient and successful process.
